RICO

Summary

Although the federal Racketeer Influenced and Corrupt Organizations law (RICO) is most commonly used in criminal prosecutions, it can apply in civil cases, providing treble damages and attorneysโ€™ fees to plaintiffs injured by repeated fraudulent or other criminal conduct.

For more than 25 years, members of our team have been obtaining courtroom victories for clients in civil RICO cases. We understand the nuances of this complicated statute from both the defense and plaintiff perspectives, and have used our knowledge of this specialized area of the law to pioneer the use of civil RICO in franchise litigation. Not every โ€œgarden varietyโ€ fraud claim is a RICO case. We know the difference and can assess the facts quickly to determine whether the RICO claim you wish to bring or the one asserted against you will survive a legal challenge.

We are not and never will be associated with one side of the street. Ask our attorneys with RICO expertise about their successes defending franchise systems and other corporate clients sued under RICO as well as their work in developing RICO claims on behalf of franchisees and other businesses (both in class actions and stand-alone litigation).ย  We have your back.
