LLG Files Lawsuit Aimed at Disqualifying Johnson, Tiffany, and Fitzgerald from Fall Election Ballot

Last week, Laffey, Leitner & Goode LLC, on behalf of ten Wisconsin voters, filed a lawsuit in the United States District Court for the Eastern District of Wisconsin seeking a declaration that Senator Ron Johnson (R-WI) and Congressmen Scott Fitzgerald (R-WI) and Tom Tiffany (R-WI) assisted in an insurrection against the United States through their roles in the conspiracy that culminated in the January 6, 2021 attack on the U.S. Capitol.  If the plaintiffs prevail, Johnson, Fitzgerald, and Tiffany could be disqualified from running for federal or state office under the Disqualification Clause of the U.S. Constitution, which is in Section 3 of the Fourteenth Amendment.

The suit asserts that Johnson, Tiffany, and Fitzgerald knowingly spread false information about the results of the 2020 presidential election and that Fitzgerald actively participated in the “certification” of fraudulent electors for Wisconsin. Plaintiffs allege that President Trump conspired with Defendants and others to deny Joe Biden’s victory and instead impose a fraudulent result in favor of President Trump. Specifically, plaintiffs assert that Trump lawyers John Eastman and Kenneth Chesebro developed a fraudulent elector strategy for 7 battleground states that Biden won in an effort to provide Vice President Mike Pence with options to throw the election to President Trump when the electoral votes were opened and counted at a Joint Session of Congress last January. In addition to accusing Congressman Fitzgerald of facilitating the crimes committed by Wisconsin’s 10 fraudulent electors when they illegally convened at the Wisconsin Capitol on December 14, 2020, the plaintiffs allege that the conspiracy needed a steady drumbeat of Trump\’s \”Big Lie\” from Johnson, Tiffany, Fitzgerald, and others in order for the public to place pressure on the Vice President to give the election to President Trump, in violation of the U.S. Constitution, numerous state and federal statutes, and the rule of law.

By pursuing their overt and illegal acts in furtherance of the conspiracy, Johnson, Tiffany, and Fitzgerald illegally attempted to disenfranchise Wisconsin’s Biden voters.\”
